OSTAPILET Terms of Use
These terms of use apply to the purchase of tickets via the OSTAPILET website, www.OSTAPILET.ee, between OSTAPILET and the Buyer.
- Definitions
1.1. OSTAPILET – OÜ OSTAPILET, registration code 14304264, which mediates the ticket sales contract between the Buyer and the Organizer.
1.2. Buyer – a person wishing to purchase a ticket: a) An adult natural person whose actions are not restricted by a valid court decision; b) Minors, including those aged 14-18, who need guardian consent for transactions unless they are using their own income; c) A legal person represented by a legal representative; d) Any authorized representatives of the above persons.
1.3. Organizer – a legal entity or ticket seller responsible for organizing the Event and accountable to the Buyer for the ticket and all related rights and obligations.
1.4. Sales Agreement – the agreement between the Buyer and the Organizer made through the OSTAPILET website when purchasing a ticket.
1.5. Website – the OSTAPILET managed and maintained online environment for purchasing tickets for Events organized by the Organizer.
1.6. Ticket – a printed or electronic original ticket or one redeemed on-site before the Event, granting the holder the right to participate in the Event.
1.7. Event – a public event organized by the Organizer (concert, performance, sports competition, fair, or other leisure event) for which a ticket purchase is necessary.
1.8. Personal Data – any information about a physical person that can identify them, including data such as name, personal code, and contact information.
- Ticket Purchase
2.1. OSTAPILET OÜ owns and manages the website through which the Buyer and Organizer can enter into sales agreements, allowing the Buyer to purchase tickets for events organized by the Organizer.
2.2. The advertising and ticket sales mediation for events listed on www.ostapilet.ee are based on a sales agreement between OSTAPILET and the Organizer.
2.3. As a mediator of the sales agreement, OSTAPILET is not responsible for the content or obligations of the sales agreement between the Organizer and the Buyer.
2.4. OSTAPILET has no obligation to fulfill the mediated sales agreement.
2.5. OSTAPILET does not buy back or exchange tickets. Only the Organizer can do this.
2.6. The terms of the sales agreement, including the Buyer's rights and the Organizer's obligations, are determined by the Organizer, who is fully responsible for the event's occurrence and compliance with advertised content.
2.7. The sales agreement between the Buyer and the Organizer is considered concluded upon the ticket price being credited to OSTAPILET's bank account.
2.8. After the payment is made, OSTAPILET will send the purchased ticket(s) to the email address provided by the Buyer.
- Buyer's Confirmations
3.1. By performing actions on the www.OSTAPILET.ee website, the Buyer confirms that they:
3.1.1. Meet the conditions specified in section 1.2 of the OSTAPILET terms of use;
3.1.2. Have legal means to complete the transaction;
3.1.3. Agree to comply with these website terms of use;
3.1.4. Provide accurate information about themselves (name, surname, and contact details) when registering as a regular customer or purchasing a ticket on the OSTAPILET website;
3.1.5. Keep their username and password safe, preventing unauthorized third-party access;
3.1.6. Acknowledge that if transactions are made by third parties using their regular customer account, the account owner is considered responsible for the transaction;
3.1.7. Understand that each purchased ticket is unique, and copying or reselling the ticket is prohibited. The QR code on the ticket allows for one-time use;
3.1.8. Are aware of their responsibility for ticket misuse;
3.1.9. Acknowledge that the Organizer is responsible for the rights and obligations related to the ticket;
3.1.10. Understand they do not have the right to withdraw from the sales agreement with the Organizer under the Obligation Act § 53 lg 4 p 72.
- Buyer's Obligations
4.1. Carefully check and ensure the accuracy of the data provided during any transaction or data entry, bearing any risk associated with errors.
4.2. Inform OSTAPILET via email at info@ostapilet.ee if tickets are not received within three hours of purchase and payment. 4.3. Not alter, copy, transmit, sell, or reproduce the ticket.
4.4. Not damage the OSTAPILET website in any way that may cause overloading or malfunctioning, with full responsibility for any resulting damages.
- Buyer's Rights
5.1. Purchase tickets for desired events advertised on the OSTAPILET website.
5.2. Register as a regular customer on the OSTAPILET website.
5.3. Submit questions, complaints, suggestions, and applications regarding ticket purchases to OSTAPILET customer support at klienditugi@ostapilet.ee.
5.4. Use discount codes and other discounts for ticket purchases if available. The Organizer or their partners provide the discounts, and OSTAPILET makes their use possible on the website. The right to the discount is checked at the event location.
- OSTAPILET's Rights
6.1. Unilaterally amend the terms of use at any time. Changes take effect from the date they are published on the website.
6.2. Discontinue the mediation of the sales agreement if there is suspicion of dishonest or illegal actions by the Buyer or if the Buyer does not meet the conditions in section 1.2.
6.3. Limit the number of tickets sold per Buyer based on instructions from the Organizer.
- OSTAPILET's Obligations
7.1. Send the purchased tickets to the email address provided by the Buyer after the purchase.
7.2. Enable a secure password reset for reusing the regular customer account if the password is lost or forgotten.
- OSTAPILET's Non-Liability
8.1. OSTAPILET is not responsible for disruptions in third-party services that may cause payment failures.
8.2. OSTAPILET is not responsible for incorrect data provided by the Buyer, such as incorrect account numbers or email addresses.
8.3. OSTAPILET is not responsible for damages if the ticket falls into the hands of third parties due to incorrect email entry, automatic forwarding, or incorrect data on the regular customer account.
8.4. OSTAPILET is not responsible for the loss, damage, or destruction of the ticket. Also, OSTAPILET is not responsible for issues arising from the deletion or loss of the ticket in the email inbox or problems during ticket printing.
8.5. OSTAPILET is not responsible for the Organizer's actions, including the accuracy of event advertisements and content, event replacement, or cancellation. All ticket-related claims are resolved by the Organizer.
8.6. OSTAPILET is not responsible for the information uploaded by the Organizer on the website or information obtained through redirecting links.
8.7. OSTAPILET is not responsible for the identity of the Buyer and ticket user and any resulting damages.
8.8. OSTAPILET's liability in any case does not exceed the ticket price paid by the Buyer.
- Intellectual Property
9.1. OSTAPILET owns all copyrights to the website. This includes the software, texts, databases, graphic designs, and color schemes.
9.2. Without prior written consent from OSTAPILET, neither the Buyer nor others may copy, distribute, transmit, translate, incorporate into other databases, make extracts from, or otherwise use the website or its components.
9.3. Unauthorized use or referencing of the website or its components without OSTAPILET's prior written consent is illegal and entails liability for damages and lost profits.
- Privacy Policy and Personal Data Processing
10.1. The privacy policy sets rules for storing, collecting, and processing personal data when using the OSTAPILET website services.
10.2. The privacy policy aims to ensure the security and protection of personal data against illegal use.
10.3. OSTAPILET, as the data processor, follows the Personal Data Protection Act, other Estonian laws, and the principles set out in the EU General Data Protection Regulation.
10.4. OSTAPILET collects and processes the following personal data: first and last name, email address, and phone number, and regular customer name provided during ticket purchase or customer registration.
10.5. By purchasing a ticket or registering as a regular customer, the Buyer consents to OSTAPILET processing their personal data. This consent includes the right for OSTAPILET to transfer personal data to companies within the same group and to a new owner in the event of a change in ownership. Personal data will not be transferred to other parties.
10.6. OSTAPILET has the right to process personal data without the Buyer's consent to fulfill legal obligations and agreements, and to use it for evidence if necessary.
10.7. OSTAPILET processes personal data minimally and only for service purposes (facilitating ticket purchase, distributing newsletters, providing payment options) and as long as necessary to achieve processing goals. OSTAPILET may retain personal data until the expiration of claim submission deadlines.
10.8. Confidentiality of Personal Data
OSTAPILET ensures the confidentiality and lawful processing of the Buyer's personal data.
10.9. Buyer's Rights
The Buyer has the right to withdraw consent for the processing of personal data at any time, request the termination of data processing, and the deletion or closure of collected personal data, including closing the loyalty account.
11. Service Fees
11.1 A service fee of 0.50 euros is added to the price of each ticket purchased through the OSTAPILET website. In special cases, additional fees may be added to the ticket price and service fee as required by the Organizer for the event to take place, which are obligatory for payment. Additionally, the Organizer may offer optional convenience services such as catering at the event, parking near the event venue, etc., which the Buyer is not obligated to purchase unless they wish to use the services.
12. Other Provisions Related to OSTAPILET Terms of Use
12.1 The terms of use come into effect between OSTAPILET and the Buyer once the Buyer provides electronic confirmation of agreement to these terms, either when purchasing a ticket or registering as a loyalty member.
12.2 OSTAPILET has the right to change the terms of use unilaterally at any time by publishing the relevant information on the website. Changes take effect from the day they are published on the website.
12.3 If any provision of the terms of use conflicts with legal requirements, it does not affect the validity and applicability of the remaining terms. If a provision is invalid under the law for a consumer Buyer, it applies only to the Buyer who is not a consumer (legal entity).
12.4 The legal relationships arising from the use of the website between OSTAPILET and the Buyer are governed by the laws of the Republic of Estonia. Any disputes arising from the purchase of tickets on the OSTAPILET website www.ostapilet.ee will be resolved through negotiation, and if no agreement is reached, in Harju County Court for legal entity Buyers; for other Buyers, jurisdiction is determined according to the law.
A consumer Buyer has the right to file a complaint with the Consumer Disputes Committee, with information available on the Consumer Protection Board's website www.tarbijakaitseamet.ee, or to submit a complaint online through the European Union's Online Dispute Resolution platform (ODR), which facilitates the resolution of disputes related to e-commerce transactions. The platform is available at https://ec.europa.eu/consumers/odr/.
12.5 These OSTAPILET website terms of use www.ostapilet.ee are approved by a decision of the OSTAPILET OÜ management board and remain in effect until updated on the website.
